摘要：La Ley 1480 de 2011 incorporó por primera ocasión en Colombia un sistema de principios tuitivos, donde destaca el acceso de los consumidores a una información adecuada que permita hacer elecciones bien fundadas, imponiendo sobre los profesionales una obligación de información que debe caracterizarse por su suficiencia, claridad, idoneidad y oportunidad. El presente artículo demuestra cómo, a pesar de concebir un crédito informativo en favor de los consumidores, su cumplimiento, exigibilidad y efectividad plantean dudas, aparte de las diversas sanciones civiles y administrativas que podrá imponer la Superintendencia de Industria y Comercio. El análisis se efectúa teniendo como referencia el derecho comparado y la tutela del consumidor dentro de la doctrina moderna de la culpa in contrahendo.
其他摘要：The new consumer protection law in Colombia, know as law 1480 of 2011 for the first time incorporated a system of protective principles, which highlights the rights of the consumers to access to the appropriated information that allows them to make informed choices, imposing an obligation on producers and distributors and other professionals of information to be characterized for its adequacy, clarity, appropriateness and timeliness. This article demonstrates how despite the law creates an information credit on consumers benefit, its enforcement, enforceability and effectiveness are in doubt despite the various civil and administrative sanctions that may be imposed by the Superintendence of Industry and Commerce. The analysis was performed having in reference the comparative law and the consumer protection within the modern doctrine of culpa in contrahendo.
