摘要：Durante el siglo XIX, el comercio ilegal de distintos géneros fue una actividad de amplias magnitudes que se realizó a lo largo del actual territorio colombiano y sobre el cual las medidas tomadas por el gobierno tuvieron incidencia. Por esta razón, el propósito de este artículo es el de examinar cómo la configuración del Estado decimonónico repercutió en el desarrollo y la persistencia de oportunidades para el contrabando. Para lograr este objetivo se abordan dos posiciones teóricas complementarias que permiten examinar la gestión estatal. Estas son, por un lado, la teoría neoinstitucionalista y, por otro lado, el superávit de oportunidades. Finalmente, como un ejercicio de revisión de los planteamientos teóricos propuestos, se analiza el caso del contrabando de oro en Antioquia durante la primera mitad del siglo XIX
其他摘要：During the 19th century, different types of illegal trade became widely spread activities all over the territory that today constitutes Colombia. Given that government policies affected illegal trade, the purpose of this article is to examine how the configuration of 19th century State had repercussions on the development and persistence of opportunities for smuggling. In order to achieve this objective, two complementary theoretical positions regarding State management are analized. On the one hand, the Neoinstitutionalist theory, and on the other, opportunity surplus. Finally, as an exercise meant to evaluate the proposed theoretical approaches, the case of gold smuggling in Antioquia during the first half of the 19th Century is analyzed
