摘要：El artículo defiende la pertenencia a la vez común y diferente de cada persona a la especie humana. Por ello, el principio de igualdad y de no discriminación es fundamental en un estado democrático. Tanto la idea neoliberal y ahora neoconservadora, idea acerca del ineludible carácter de desigualdad y la pretensión de comunitarismo multicultural de que haya diferentes derechos para mujeres y niños, por un lado, como la reducción de la complejidad humana a unos pocos grupos predeterminados, por otro, son inadmisibles. El Estado democrático debe ser pluralista, por supuesto, pero ello bajo una ley común para todos. Consecuentemente, la autora rechaza la idea de un pluralismo judicial que en realidad implica relaciones de dominación interpersonal
其他摘要：The article defends the common and differente membership of every person into the human specie. Principle of Equality and Non Discrimination is nuclear in a democratic State for that reason. Both the neoliberal and now neoconservative idea about the ineluctable character of inequality and the pretension of the multicultural communitarianism of inequal rights for women and children and the reductions of human complexity to a few predetermined groups are inadmisible. The democratic State must be pluralistic, of course, but under a common law for everybody. So the author rejects the idea of a juridical pluralism that in reality signifies keeping interpersonal domination relations. The article defends the common and different membership of every person in the human species. For that reason, the Principle of Equality and Non Discrimination is crucial in a democratic State. Both the neo-liberal and now neo-conservative idea about the ineluctable character of inequality and the pretension of the multicultural communitarianism of unequal rights for women and children, on the one hand, and the reduction of human complexity to a few predetermined groups, on the other, are unacceptable. The democratic State must be pluralistic, of course, but under a common law for everybody. Consequently, the author rejects the idea of a juridical pluralism that in reality means keeping interpersonal domination relations.
