摘要：Science very advanced in the field of the reproduction human being and can provide to the barren couples to have children. The possibility appears of the use of genetic material of a giver to occur the fecundação. With this, we have the sprouting of one third person in the reproduction process, the giver. The son, of these techniques been born, is not biological son of one of its parents generating conflict between the biological paternity and the legal paternity. The giver cannot be known, must remain in the anonymity and it cannot demand the paternity, it transfers to conceive it the filiation not more established in the biological bows but yes, in the affectivity bows, the call "desbiologização", where it takes advantage the fondness of the parents and the welfare of the child.
