摘要:The trajectory of Brazilian legislation demonstrates the legislator’s intention to guarantee, in practical order, the principle of legal certainty. The problem analyzed in this article is based on the observation that this principle, as established in the Federal Constitution, was not properly disciplined and regulated in the administrative field. As a hypothesis, this paper seeks to examine the recent innovations in LINDB that demonstrate the need to enshrine the aforementioned principle. Attentive to the new conformation of the public administration, the legislator added art. 30 to LINDB, in order to ensure greater compliance with legal certainty in the application of the standard. The purpose of this article is to elucidate the concept of legal certainty that has its own regulatory density and content.
