摘要：Purpose - To apply the theory of responsive regulation through governance networks and to provide new regulatory strategies to be followed by the Brazilian National Mining Agency (NMA), aiming to improve and contribute to the regulation and control of the safety of these enterprises. Methodology/approach/design - The approach would be to revise the regulations issued by the NMA since 2017 on the safety of mining tailings dams in Brazil, analyzing possible past improvements or proposing new ones, applying the responsive theory of regulation focusing on governance networks. Findings - Identify more effective and participatory control solutions, assisting in the supervision of NMA and promoting transparency and improved safety control in mining dams in Brazil. Practical Implications - Application of this theory and regulatory strategy for more effective and transparent control of these dams. Originality/value - In recent years, two dams have breached in the state of Minas Gerais, causing hundreds of deaths and serious environmental damage. These accidents highlighted the difficulties in the effective application of the National Dam Safety Policy (NDSP) and the low operational capacity of NMA inspection.↓Propósito – Aplicar a teoria da regulação responsiva voltada a países em desenvolvimento, por meio de redes de governança, e fornecer novas estratégias regulatórias a serem seguidas pela Agência Nacional de Mineração (ANM), com objetivo de aprimorar e contribuir com a regulação e controle da segurança desses empreendimentos. Metodologia/abordagem/design – A abordagem se daria com a revisão dos normativos editados pela Agência Nacional de Mineração a partir de 2017 sobre segurança de barragens de rejeitos de mineração no Brasil, analisando a ocorrência de um possível aprimoramento ou a proposição de novos, aplicando-se teoria responsiva da regulação, com enfoque em redes de governança. Resultados – Identificar soluções de controle mais efetivas e participativas, auxiliando na fiscalização da ANM, promovendo transparência e um aprimoramento no controle na segurança nas barragens de mineração no Brasil. Implicações práticas – Aplicação dessa teoria e de estratégia regulatória para um controle mais efetivo e transparente dessas barragens. Originalidade/relevância do texto – Nos últimos anos, duas barragens romperam no Estado de Minas Gerais ocasionando centenas de mortes e danos ambientais gravíssimos. Esses acidentes evidenciaram as dificuldades na aplicação efetiva da Política Nacional de Segurança de Barragens (PSNB) e a baixa capacidade operacional de fiscalização da ANM.
