摘要：O reconhecimento de uma ordem jurídica internacionalmente válida e que seja capaz de resolver os conflitos emergentes da sociedade internacional, através da legitimação de um direito acessível a todas as nações, é uma preocupação clássica na história da filosofia do Direito internacional. Tal preocupação reflete-se, principalmente, na doutrina da guerra justa, que tem por expoentes, dentre outros, os jus-filósofos Hugo Grócio e Alberico Gentili, pioneiros no desenvolvimento do conceito de jus gentium , ou direito das gentes, concepção predecessora da noção de Direito Internacional. O presente artigo, através do emprego do método hipotético-dedutivo, objetiva expor, comparativamente, as principais contribuições desses autores, tomando por base suas mais célebres obras. Em um primeiro momento, os autores e suas obras são contextualizados no momento histórico em que viveram. Após, são apresentadas suas teorias a respeito do direito das gentes e da doutrina da guerra justa. Por fim, conclui-se que a maior inovação dos autores está no fato de terem formulado uma noção de direito internacional que retira seu fundamento de validade e legitimação da existência racional humana.

Abstract The recognition of an internationally order valid and capable of resolving disputes arising from the international society; through the legitimization of an accessible right for all nations; is a classic preoccupation in the history of the philosophy of international law. This preoccupation is reflected; mainly; in the doctrine of just war; which has for exponents; among others; the jus-philosopher Hugo Grotius and Albericus Gentilis; pioneers in the development of the concept of jus gentium ; or law of nations; the predecessor concept of the notion of international law. This paper; through the use the hypothetical-deductive method; objective expose comparatively the main contributions of these authors; based on his most famous works. In a first moment; the authors and their works are contextualized in the historical moment in which lived. After; his theories about the law of nations and the doctrine of just war are presented. Finally; it is concluded that the greatest innovation of the authors is in the fact that they had conceived a notion of international law which withdraws your fundament of validity and legitimacy of rational human existence.
