摘要：O direito à identidade, percebido como direito da personalidade, estabelece pontos relevantes acerca de a identidade ser tutelada tanto pela esfera cível quanto pela esfera penal, assim como se verifica a possibilidade de não só a pessoa humana, ser titular de tal direito como também a possibilidade de a pessoa jurídica ser titular do direito à identidade. É, portanto, sobre estes aspectos que o presente estudo busca analisar a importância da tutela à identidade pessoal para com a sociedade. Concluindo-se deste modo, pela relevante adequação aos anseios da sociedade frente a proteção jurídica cível e penal ao que diz respeito aos direitos de personalidade – identidade.
其他摘要：The identity right, perceived as the personality right, provides relevant points about the identity subordinate to both the civil sphere and the criminal sphere, and there is the possibility of not only the human people to have this right as well the possibility of a legal entity to hold the identity right. Therefore, these aspects that this study seeks to analyze the importance of personal identity protection to society. Concluding therefore, the relevant adjustment to the society expectations against the legal protection of civil and criminal matters regarding to personality - identity rights.
