摘要：2001年4月の情報公開法の施行と国立公文書館法の一部改正により，国の行政機関から国立公文書館への新しい公文書移管制度が始まった。しかし移管は円滑に進んでいるとは言えず，現在内閣府に置かれた「公文書等の適切な管理，保存及び利用に関する懇談会」の報告書の提言に基づき，改革が進められている。公文書等の移管は各行政機関と内閣総理大臣の合意に基づいて行われる。国立公文書館は移管についての意見を内閣総理大臣に提出できるが，意見照会しても必ずしも移管に結びつかない。諸外国の例に学びながら，政府機能の把握，公文書の廃棄権限，現用・非現用文書の概念の見直し，文書管理法等の検討が必要である。
其他摘要：The new transferring system for public records from government organizations to the National Archives of Japan started in April 2001 based on the National Archives Law and Information Disclosure Law. However, it turned out that the system caused many problems. The power and authority of the National Archives of Japan are limited and the opinions of the Archives do not properly reflect to the results of the number of the records transferred to the Archives. Based upon the proposals issued by the Panel advising Chief Cabinet Secretary on national archival systems in June 2004, Cabinet Office and the National Archives of Japan have been tackling with the challenges of the records transferring system.
