标题:A responsabilidade internacional norte-americana na jurisdição comercial da Organização Mundial do Comércio a partir do caso WTO-OSC/DS267 - upland cotton
摘要:O presente trabalho tem como pano de fundo das discussões apresentadas, a análise assentada nas reflexões sobre a responsabilidade internacional do Estado e as jurisdições internacionais, recaindo sobre a responsabilidade internacional norte-americana na jurisdição comercial da Organização Mundial do Comércio (OMC), a partir do caso WTO-OSC/DS267 - Upland Cotton. É inevitável afirmar que sempre existirão conflitos de interesses nacionais, sujeitos às regras comerciais reconhecidas internacionalmente, o que leva a necessidade dos organismos internacionais efetivarem um mecanismo de harmonização através da tomada de decisões calcadas na regulamentação do comércio internacional. Considerando que a obrigação que um Estado tem com o outro de reparar o dano que causou está consagrada como um princípio do Direito Internacional Público. Os princípios gerais de direito internacional se aplicam à OMC e a seus acordos. Nesse sentido, a relação de responsabilidade internacional, no Sistema de Soluções de Controvérsia (SSC) da OMC, transcende as partes envolvidas numa disputa, pois diz respeito a todos os membros da OMC.
其他摘要:This paper discusses the international responsibility of the State and the role of international jurisdictions – specifically analyzing the international responsibility of the United States in the commercial jurisdiction of the World Trade Organization, utilizing the WTO-OSC/DS267, known as the Upland Cotton case. For the State, it is inevitable that there will always be conflicts of interest subject to internationally recognized trade rules. This leads to a situation where international organizations need to implement a harmonization mechanism using decisions based on the regulation of international trade. Moreover, a State has the obligation to repair damage caused by disrespecting principles of Public International Law. Furthermore, general principles of international law apply to the WTO and its agreements. In this sense, the relationship of international responsibility in the WTO Dispute Settlement System (SSC) transcends party involvement in disputes as it concerns all the WTO members.
