摘要：Artigo que pretende discutir, a partir da evolução dos conceitos de família e filiação, o valor jurídico do afeto. Para tanto, traçaremos um paralelo entre a paternidade biológica, restrita a uma concepção de genética e a paternidade socioafetiva, que retrata a subjetividade dos laços estabelecidos por meio dos nobres sentimentos do amor, carinho, cuidado, dentre outros, para mostrar que o direito vem atribuindo maior valor às relações afetivas quando em conflito com a relação estritamente biológica.
其他摘要：Article aims to discuss, from the evolution of the concepts of family and membership, the legal value of affection. Therefore, we will draw a parallel between biological paternity, restricted to a conception of genetic and socio-affective paternity, which depicts the subjectivity of the links established by the noble feelings of love, affection, care, among others, to show that the right comes assigning greater value the personal relationships when in conflict with the strictly biological relationship.
