摘要：This article discusses the outsourcing process taking for granted a legal research of review and exploratory nature aimed to bring an analysis of the outsourcing evolution of the Brazilian Public Administration through the study of the norms as well as the experts and scholars related to the issue in order to demonstrate through a deductive logic that the controversy generated by arguments against and in favor outsourcing have reverberated conflicts even in the jurisprudence of the Superior Labor Court (TST) and the Federal Supreme Court (STF), since there is no specific legislation in the country.
