摘要:Partindo da caracterizecáo do significado do direito a educacáo como direito social proclamado e considerandose que a cada direito corresponde wn dever, examinamse as vicissitudes decorrentes do conflito entre o direito educacáo e o dever de educar na história da educacáo brasileira. Em seguida, é analisada a persistencia do referido conflito na situacáo atual para, guisa de conclusáo, considerarse as perspectivas de solucáo, o que póe em foco o problema da organizecáo do Sistema Nacional de Educacáo.
其他摘要:From the characterization of the meaning of the right to education as an affirmed social right and considering that to every right there is a corresponding duty, we examine the changes resulting fro m the conflict between the right to education and the duty to educate in the history of Bra- zilian education. Next, the persistence o f such conflict in the current situation is analyzed so that; as a conclusion, the perspectives for a solution are consid- ered, which puts the problem of the organization of the National System of Education in the spotlight.
