摘要：Partindo da caracterizecáo do significado do direito a educacáo como direito social proclamado e considerandose que a cada direito corresponde wn dever, examinamse as vicissitudes decorrentes do conflito entre o direito educacáo e o dever de educar na história da educacáo brasileira. Em seguida, é analisada a persistencia do referido conflito na situacáo atual para, guisa de conclusáo, considerarse as perspectivas de solucáo, o que póe em foco o problema da organizecáo do Sistema Nacional de Educacáo.
其他摘要：From the characterization of the meaning of the right to education as an affirmed social right and considering that to every right there is a corresponding duty, we examine the changes resulting fro m the conflict between the right to education and the duty to educate in the history of Bra- zilian education. Next, the persistence o f such conflict in the current situation is analyzed so that; as a conclusion, the perspectives for a solution are consid- ered, which puts the problem of the organization of the National System of Education in the spotlight.
