摘要：A raíz de un penoso incidente ocurrido en la cárcel chilena,emerge este trabajo que tiene como objetivo primordial reflexionar analíticamenteen torno al rol del Estado frente a la vinculación de dos construcciones culturalescomo lo son el sistema carcelario, por una parte, y los derechos humanos, por otra.El estudio revisa ambos constructos –en el marco del papel que juega el Estado-advirtiéndose claramente el carácter cultural de los mismos, aunque también susmarcadas diferencias en tanto origen y enclaves que los generaron, incluso respectode los saberes que aquellos estudios que los refieran puedan gestar. Las especulacio-nes éticas que entornan ambas tecnologías, la carcelaria y la que implican los dere-chos humanos, llevan a la conclusión que la conexión debe hacerse en el afán de laconstitución de una sociedad decente, rescatando al sujeto humano de la humilla-ción, sujeto humano que se puede representar en el anormal.
其他摘要：Following a sad incident that took place at a chilean prison,emerges this work that aims primarily to reflect analytically about the role of theState and the connection of two cultural constructions, the prison system on theone hand and human rights on the other. The study reviews both constructs -in thecontext of the role the State has-, clearly establishing the cultural character of thesame, but also stating their strong differences both in their origin, and in the encla-ves that generated them, including the knowledge that related studies can gestate.The ethical speculations that surround the two technologies, involving prison andhuman rights, leads to the conclusion that the connection must be done in the effortof creating a decent society, rescuing the human subject from humiliation, thehuman subject that may represented in the abnormal.
