摘要：O presente artigo busca analisar o papel dos princípios jurídicos no processo decisório das Cortes e dos juízes. Serão apresentadas as ideias dos três autores escolhidos - Robert Alexy, Cass Sunstein e Ronald Dworkin – sendo estas adequadas ao tema proposto. A partir disso, são mostradas as críticas e semelhanças entre as teorias, e por fim, uma contextualização para a realidade em que vivemos, com o objetivo de se afirmar a importância de uma consideração dialógica entre estas na aplicação do direito ao caso concreto.
其他摘要：This paper analyzes the role of legal principles in the decision making process of courts and judges. It discusses ideas relatively to three authors as follows: Robert Alexy, Cass Sunstein and Ronald Dworkin – all then being fit to the proposed themes. From this, every theory is reviewed in terms of comparison finding similarities and differences between them. Finally, it contextualizes the reality in which we live in order to assert the importance of a dialogue that takes into consideration how to apply the law to individual cases in accordance to the three reflections.
