摘要：This study aims to test the validity of the discretionary legal product in the form of the Instruction of the Minister of Home Affairs Number 15 of 2021 concerning the Enforcement of Restrictions on Emergency Community Activities for Corona Virus Disease 2019 in the Java and Bali Regions in Indonesia. This research is a normative legal research. The results of the study show the validity of the Instruction of the Minister of Home Affairs Number 15 of 2021 concerning the Enforcement of Restrictions on Emergency Community Activities for Corona Virus Disease 2019 in the Java and Bali Regions, based on the fact that the Ministerial Instruction as a form of policy regulation was born from the free authority (discretion) owned by the government. So in the context of the Instruction of the Minister of Home Affairs Number 15 of 2021 concerning the Enforcement of Restrictions on Emergency Community Activities for Corona Virus Disease 2019 in the Java and Bali Regions in terms of its formation, it must refer to the provisions contained in Article 24 of Law Number 30 of 2014 concerning Administration. Government, based on the results of this study, this is not fulfilled.
