摘要:The Brazilian Law seeks to guarantee a dignified life to those in a deficit situation, supported by the minimal parameters for the human being’s existence in a democratic rule-of-law state. The guarantee of a dignified life forcefully involves the access to health services and good medical treatment that should be offered by the State, but are not for reasons alien to the people’s will. The existence of public health services is undeniable, but they are far from guaranteeing the minimal conditions to those who make use of such services, and a large segment of the Brazilian population makes use of private health services or health insurance. Such services are part of the side benefits offered by the companies to their employees. The country’s legislation seeks to guarantee the maintenance of such benefits to those who have contributed to health services or health insurances for at least ten years and that, being retired, are terminated for cause.
