摘要：This essay had as purpose to analyze how the obesity is being approached in the Brazilian legislation. It was used the Speech Analysis (AS) in the Foucaultiana perspective as methodology. The empirical corpus consisted in a search for the key-words “obesity” and “overweight” in the web site Jusbrasil, where 46 rules were found. The analysis of this material indicated that it stands out a tendency to blame the obese, instigation to medical treatment and a discursive emphasis on the “combat” against obesity. It was found little concern on the guarantee of the rights of the group.
